Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 160422-08, 160422-10, 160422-11, 160422-06, 160422-07, 160422-09, 160422-03, 160422-04, 160422-05, 160422-01, 01, 160422-12, 160422-13A, 160422-02B, 16 0422 13, 16 0422 14 and 16 0422 15, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
Prior to the commencement of the development hereby approved, a schedule of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 and CSEN3 of the South Oxfordshire Core Strategy 2027 and Policies CON5, CON7, D1, E8, G2, H4 and D1 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), development as described in Schedule 2, Part 1, Class A, Class B, Class C, and Class E of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority.
Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity and in accordance with Policy CSQ3 and CSEN3 of the South Oxfordshire Core Strategy 2027 and Policies CON5, CON7, D1, E8, G2, H4 and D1 of the South Oxfordshire Local Plan 2011.
Privacy screens between the balcony areas of the two dwellings in the converted rehearsal building shall be implemented along the rear (south) elevation. These screens shall be glazed in obscure glass with a minimum of level 3 obscurity and shall be a minimum of 1.7 metres in height, prior to the first occupation of the accommodation and it shall be retained as such thereafter.
Reason: To ensure that the development is not unneighbourly in accordance with Policies D4 and H4 of the South Oxfordshire Local Plan 2011.
Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with drawing no.16/0422-02 Rev B and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of any site works (including demolition or site clearance) a protected area shall be designated for all existing trees which are shown to be retained, and the trees shall be protected in accordance with a scheme which complies with the current edition of BS 5837: "Trees in relation to design, demolition and construction" that shall first have been submitted to, and approved in writing by, the Local Planning Authority. The agreed measures shall be kept in place during the entire course of development.
Reason: To safeguard trees which are visually important in accordance with Policies CSEN1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies CON7, CON5, G2, C9 and D1 of the South Oxfordshire Local Plan 2011.
The development hereby approved shall be implemented strictly in accordance with the supporting Technical Briefing Note (Aspect Ecology, 17/05/2017) and drawing 16/0422-12. This condition will be discharged through the receipt of a letter from the project ecologist upon completion, confirming that the bat mitigation measures have been implemented in accordance with the approved details. Any variation from the approved details shall need to be agreed in writing by the Local Planning Authority before any such change is implemented.
Reason: To protect the important species on site and ensure that there is a no net-loss of biodiversity resource on site, in accordance with Policies C6 and C8 of the South Oxfordshire Local Plan 2011, and Policy CSB1 of the South Oxfordshire Core Strategy 2027.
The development hereby approved shall be implemented in accordance with the following sections of the supporting Ecological Appraisal (Aspect Ecology, 08/12/2016, File Reference: 4503-EcoAp.dv4.RP.AH): 6.1.2, 6.1.14, 6.1.18, 6.1.19, 6.1.20, 6.1.21, 6.1.22, 6.1.23 and 6.2.2. Any variation from the aforementioned sections shall need to be agreed in writing by the Local Planning Authority before any such change is implemented.
Reason: To protect the important species on site and ensure that there is a no net-loss of biodiversity resource on site, in accordance with Policies C6 and C8 of the South Oxfordshire Local Plan 2011, and Policy CSB1 of the South Oxfordshire Core Strategy 2027.
The development of the rehearsal/accommodation building permitted by this planning permission shall only be carried out in accordance with the approved Flood Risk Assessment (FRA) (prepared by: PFA Consulting; dated: December 2016; reference: S546) and the following mitigation measures detailed within the FRA:
- The finished floor levels are set at 37.01m AOD.
The mitigation measures shall be fully implemented prior to occupation and subsequently in accordance with the timing / phasing arrangements embodied within the scheme, or within any other period as may subsequently be agreed, in writing, by the local planning authority.
Reason: To reduce the risk of flooding to the proposed development and future occupants.
The development hereby permitted shall not commence until the following details are submitted to and approved in writing by the Local Planning Authority. Thereafter the development shall be carried out in accordance with the approved details.
a) Details of flood resilient construction
b) Details of sustainable drainage proposals
c) Flood Evacuation Plan for new residential units
Reason: To reduce the risk of flooding to the proposed development and future occupants.
The development hereby permitted shall not be occupied until surface water drainage works have been carried out in accordance with details that have been first submitted to and approved in writing by the Local Planning Authority.
Reason: To prevent pollution and flooding in accordance with Policies EP1, EP4 and EP6 of the South Oxfordshire Local Plan 2011.
