Partial demolition of existing care home, Eastfield House, construction of extensions and associated works and change of use of land at the rear of the home from C3 to C2 to provide additional external amenity space.
The site currently benefits from planning permission granted under Appeal Ref. APP/Q3115/A/13/2192681, dated 21 August 2013
Conditions / Refusal Reasons
Development shall not commence until details of the reserved matters (landscaping) have been submitted to and approved in writing by the Local Planning Authority.
In the case of any reserved matter, application for approval must be made not later than the expiration of three years beginning with the date of the grant of outline planning permission.
Thereafter the development shall commence not later than whichever is the later of the following dates:
(a) the expiration of three years from the date of this permission; or
(b) the expiration of two years from the final approval of the reserved matters, or in the case of approval on different dates, the final approval of the last such matter to be approved.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 344/001 N, 344/002 H, 344/003 G, 344/004 H, 344/005 H, 344/006 J, 344/009, 344/010 D, 344/011 A, LOC 001, 344/012 B, 344/013 A, 344/014 D, 344/016 A, 3096sw-01 A, 3096sw-02 B and 9658 A, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
Prior to the commencement of the development hereby approved samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, CON7 and D1 of the South Oxfordshire Local Plan 2011.
Prior to first occupation of the development hereby permitted the windows at first and second floor levels in the west side elevation shall be obscure glazed and fixed shut and thereafter permanently retained in that condition.
Reason: To ensure that the development is not unneighbourly in accordance with Policy D4 of the South Oxfordshire Local Plan 2011.
No part of the development hereby permitted shall be occupied until space has been laid out within the site in accordance with Drawing nos. 344/010 Rev D and 344/011 Rev A for cars to be parked and for vehicles to turn so
that they may enter and leave the site in forward gear. The vehicle parking and turning areas so provided shall thereafter be permanently retained for their designated purpose and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.
Prior to the first occupation of the development hereby approved a Travel Plan shall be submitted to and approved in writing by the Local Planning Authority. Thereafter the Travel Plan shall be implemented as approved on first occupation of the development hereby approved and maintained thereafter, and also updated appropriately in accordance with details to be set out within the Travel Plan.
Reason: To promote the use of non car modes of transport in accordance with Policy CSM2 of the South Oxfordshire Core Strategy 2027.
Prior to the commencement of the development hereby permitted a scheme for the landscaping of the site, including the planting of live trees and shrubs, the treatment of the access road and hard standings, and the provision of boundary treatment shall be submitted to and approved in writing by the Local Planning Authority. These details shall include the materials of paved areas and other hard surfaces and the arrangements for cycle parking and bin storage. Details of soft landscape works shall include planting plans, schedules of plants noting species, plant sizes and proposed numbers/densities, where appropriate, and an implementation programme. The scheme shall be implemented prior to the first occupation or use of development or in accordance with the programme agreed with the Local Planning Authority; and any trees or plants which within a period of five years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of a similar size and species unless the Local Planning Authority gives written approval to any variation.
Reason: To help to assimilate the development into its surroundings in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9, CON7 and D1 of the South Oxfordshire Local Plan 2011.
Tree protection measures shall be undertaken in accordance with the details contained in the TDA Tree Constraints Plan, Pre-Development Tree Survey and Assessment of July 2009 (updated March 2012) and TDA Arboricultural
Method Statement dated March 2012 before any equipment, machinery or materials are brought on to the site for the purposes of the development and shall be maintained until all equipment, machinery and surplus materials have
been removed from the site. Nothing shall be stored or placed in any area fenced in accordance with this condition and the ground levels within those areas shall not be altered, nor shall any excavation be made, without the prior written approval of the Local Planning Authority.
Reason: To safeguard trees which are visually important in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011
The development hereby permitted shall be implemented in accordance with the Mitigation proposals contained in Chapter 6 of the Bat Survey Report (NLG Ecology Ltd August 2014) submitted with the application in all respects. Any variation shall be agreed in writing by the Local Planning Authority before such change is made.
Reason: To protect the important species on the site, in accordance with provisions of the NPPF and Policies CSB1 of the South Oxfordshire Core Strategy 2027 and C8 of the South Oxfordshire Local Plan 2011.
The development hereby permitted shall not be used for any purpose other than as a care home under Class C2 of the Town and Country Planning (Use Classes) Order 1987 (as amended).
Reason: To protect the amenity of nearby residential properties and in the interests of highway safety in accordance with Policies EP2 and T1 of the South Oxfordshire Local Plan 2011.
Demolition or construction works shall not take place outside the following hours: 0800 to 1800 Mondays to Fridays and 0800 to 1300 on Saturdays, nor at any time on Sundays or Bank Holidays.
Reason: To protect the occupants of nearby residential properties from noise and dust disturbance during the development of the site in accordance with Policies EP1 and EP2 of the South Oxfordshire Local Plan 2011.
No external lighting shall be installed at the development hereby permitted without the prior approval in writing of the Local Planning Authority.
Reason: To safeguard the amenity of neighbouring residents and the character of the area in accordance with Policies CSEN1 and CSEN3 of the South Oxfordshire Core Strategy 2027 and Policies EP3 and CON7 of the South Oxfordshire Local Plan 2011.
The development hereby permitted shall not be occupied until surface water drainage works have been carried out in accordance with details that have been first submitted to and approved in writing by the Local Planning Authority.
Reason: To prevent pollution and flooding in accordance with Policies EP1, EP4 and EP6 of the South Oxfordshire Local Plan 2011.
The development hereby permitted shall not be occupied until foul drainage works have been carried out in accordance with details that have been first submitted to and approved in writing by the Local Planning Authority.
Reason: To prevent pollution in accordance with Policy EP1 of the South Oxfordshire Local Plan 2011.
