Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That no development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a schedule of materials and finishes for the external walls and roofs of the buildings. Thereafter the buildings shall be constructed and finished in accordance with those agreed details. Reason: To ensure that the details of the development are satisfactory in accordance with Policies G2, G6, CON7 and D1 of the adopted South Oxfordshire Local Plan 2011.

That no dwelling shall be occupied until the parking provision has been constructed, surfaced and laid out, as shown on site plan drawing no. 996 011D unless otherwise agreed in writing by the Local Planning Authority; and such parking provision shall thereafter be retained. Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities in accordance with Policies G2 and D2 of the adopted South Oxfordshire Local Plan 2011.

That the dwellings shall not be occupied until the cycle and bin storage areas shown on site plan drawing no. 996 011D have been provided unless otherwise agreed in writing by the Local Planning Authority; and that those areas shall be thereafter retained. Reason: To comply with the Local Planning Authority's parking standards and to protect local amenities in accordance with Policies G2, G6 and D2 of the adopted South Oxfordshire Local Plan 2011.

That a scheme for the landscaping of the site, including the planting of live trees and shrubs and the provision of boundary fencing and screen walling, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. Reason: To help to assimilate the development into its surroundings in accordance with Policies G2, C9 and CON7 of the adopted South Oxfordshire Local Plan 2011.

The landscaping scheme agreed under the previous condition shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme to the complete satisfaction of the Local Planning Authority. In the event of any of the trees or shrubs dying or being seriously damaged or destroyed within 3 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies G2, C9 and CON7 of the adopted South Oxfordshire Local Plan 2011.

That no development shall take place until the Local Planning Authority is satisfied that contamination has been sufficiently investigated and any remedial action approved, in accordance with the steps identified in the attached information from the Council's Environmental Health department. The site shall then not be occupied until any agreed action is implemented and approved by the Local Planning Authority in writing. Reason: To ensure that any ground and water contamination is identified and adequately addressed to ensure the safety of the development, the environment and the public and to ensure that the site is suitable for its proposed use in accordance with G2 and EP8 of the adopted South Oxfordshire Local Plan 2011.

That the existing trees adjacent to the boundaries of the site shall be protected whilst development operations are in progress, in accordance with a scheme to be first agreed in writing with the Local Planning Authority and to be implemented prior to the commencement of the development. Reason: To safeguard trees which are visually important in the surrounding landscape and to assimilate the development into its surroundings in accordance with Policies G2 and C9 of the adopted South Oxfordshire Local Plan 2011.

That foul drainage details shall be submitted to and approved in writing by the Local Planning Authority prior to the development commencing and thereafter the approved foul drainage scheme shall be implemented in accordance with these details. Reason: In the interests of public health in accordance with Policies G2 and EP1 of the adopted South Oxfordshire Local Plan 2011.

That details of surface water drainage works shall be submitted to and approved in writing by the Local Planning Authority prior to the development commencing and thereafter the surface water drainage scheme shall be implemented in accordance with these details. Reason: In the interests of public health in accordance with Policies G2 and EP1 of the adopted South Oxfordshire Local Plan 2011.

That no soakaways shall be constructed in contaminated land. The depth of soakaways shall not exceed 2 metres below the existing ground level and shall not be constructed so that they penetrate the water table. Reason: To prevent the pollution of ground water in accordance with Policies G2, EP1 and EP7 of the adopted South Oxfordshire Local Plan 2011.

That the development hereby permitted shall be carried out in strict accordance with the details contained within the Flood Risk Assessment (FP250437/HG/002 dated 17 November 2005) and which must also include the details indicated by amended drawing numbers 250437-SK02 Rev B and 250437-SK04 Rev C. Reason: To prevent the increased risk of flooding in accordance with Policies G2 and EP5 of the adopted South Oxfordshire Local Plan 2011.

That a footpath link shall be provided between the railway station and Meadow Road before completion of the development and shall be made available to the public during daylight hours. Reason: To provide a clear choice of movement routes and transport modes associated with the development in accordance with Policies G2 and D1 of the adopted South Oxfordshire Local Plan 2011.

That details of the signage to be used to in conjunction with the footpath link between the railway station and Meadow Road shall be submitted to and approved in writing by the Local Planning Authority and thereafter installed in accordance with these agreed details within one month of the completion of the development. Reason: To provide a clear choice of movement routes and transport modes associated with the development in accordance with Policies G2 and D1 of the adopted South Oxfordshire Local Plan 2011.

That details of the acoustic measures to be incorporated into the development to attenuate noise within the dwellings hereby permitted shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development and thereafter shall be implemented prior to the occupation of any dwelling and retained in accordance with these details. Reason: To ensure satisfactory levels of residential amenity in accordance with Policies G2 and EP2 of the adopted South Oxfordshire Local Plan 2011.

That the window in bedroom 2 of flats 2, 3 and 5 shall be relocated to the rear elevation of the building in accordance with further plans which shall first have been submitted to and approved in writing by the Local Planning Authority. Reason: To ensure satisfactory levels of residential amenity in accordance with Policies G2, EP2 and D4 of the adopted South Oxfordshire Local Plan 2011.

That the block of flats nearest the north-western end of the site shall be sited a minimum of 1 metre from the edge of the parking area in accordance with further plans which shall first have been submitted to and approved in writing by the Local Planning Authority. Reason: To ensure satisfactory levels of residential amenity in accordance with Policies G2, EP2 and D4 of the adopted South Oxfordshire Local Plan 2011.
